Privacy policy

In accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD), users are informed of the processing of their personal data.

Recipients

Data is shared, strictly as necessary, with: TuriTop (booking platform), the payment processor, our web hosting provider and, if you accept their cookies, Google (embedded map and fonts). When you contact us via WhatsApp, processing is also subject to WhatsApp's (Meta's) terms. We do not sell data to third parties. Where a provider is located outside the European Economic Area, transfers are covered by appropriate safeguards (standard contractual clauses or valid adequacy frameworks).

Retention

We keep data for the duration of the customer relationship and thereafter for the applicable statutory periods (in particular tax and accounting obligations).

Your rights

You may exercise your rights of access, rectification, erasure, objection, restriction and portability by writing to info@sunnysailingbcn.com, attaching proof of identity. If you believe the processing is not compliant, you may lodge a complaint with the Spanish Data Protection Agency (www.aepd.es).

Minors

Bookings may only be made by persons aged 18 or over.

Cookies and similar technologies (such as browser local storage) are small files stored on your device when you visit a website. This Website uses them in a very limited way:

The site's fonts are served by Google Fonts, which involves a technical request to Google but does not set cookies. If we activate analytics or advertising tools in the future (e.g. Google Analytics or Google Ads), this policy will be updated and your prior consent will be requested.

Managing your choice

On your first visit you can "Accept" all cookies or choose "Essential only". To change your decision later, clear this site's data in your browser settings (Chrome, Firefox, Safari or Edge: privacy → cookies and site data) and reload the page; the banner will appear again.

Booking terms

These General Terms govern the booking of the sailing experiences offered by Sunny Sailing BCN (the "Provider"). By completing a booking, the customer declares that they have read and accepted them.

The Provider offers shared and private sailboat trips departing from Port Olímpic, Barcelona. The features, duration and price of each experience are described on its page. Bookings are made through the secure TuriTop platform integrated into the website (or, by prior arrangement, via WhatsApp or email) and are confirmed once the customer receives the confirmation email after payment. If you do not receive confirmation within a few minutes, check your spam folder and contact us if needed.

3. Prices and payment

Published prices include applicable VAT and cover: the described trip, a licensed professional skipper, fuel and the vessel's mandatory insurance and civil liability cover, an aperitif and a drink per guest, plus anything expressly listed for each experience. The stated duration of each trip is indicative and the skipper may adjust it slightly depending on sea conditions. Price changes will not affect confirmed bookings. Payment is processed by card through the booking platform's secure gateway; the Provider does not store card details.

4. Meeting point and punctuality

Boarding takes place at Moll de Mestral, moorings 1539 & 1540 (Port Olímpic). Customers must arrive 15 minutes before departure time. Out of respect for other passengers and nautical planning, the boat cannot delay departure: failure to show up or arrival after cast-off is considered a no-show and gives no right to a refund or date change. We recommend allowing extra travel time, especially in high season.

Cancellations must be notified by email or WhatsApp, quoting the booking number; the effective date is the date the notice is received. Date changes requested by the customer are subject to availability and the same notice periods: within penalty periods they are treated as a cancellation plus a new booking.

If an optional cancellation insurance is offered during checkout, purchasing it allows you to modify or cancel under that insurance's terms, regardless of the periods above.

6. Cancellation by the Provider and weather

Safety is non-negotiable. The skipper may cancel or cut short a trip when sea or weather conditions do not guarantee the safety of people or vessel, or in other cases of force majeure. In that event the customer may choose between rescheduling, subject to availability, or a full refund of the amount paid. The Provider is not liable for indirect costs (travel, accommodation or others). The skipper may also adjust the route or duration for safety reasons without this constituting a breach, provided the essential contracted service is delivered.

8. Swimming stop

Where the experience includes a swim stop, swimming takes place only with the skipper's authorisation, depending on sea conditions and season, and at each participant's own responsibility. Life jackets and flotation devices are available on board; minors must be supervised by the responsible adult at all times.

9. Minors and personal conditions

Guests under 18 must be accompanied by a responsible adult. For safety reasons, children under 3 cannot board. Pregnant guests and people with reduced mobility or relevant medical conditions should contact us before booking: sailing involves movement and heeling of the boat.

10. Personal belongings and damage

Each passenger is responsible for their belongings; the Provider is not liable for loss, damage or items dropped into the sea (waterproof phone pouches are recommended). Damage caused to the vessel or its equipment through negligence or misuse will be charged to the customer responsible.

11. Images

We may take photos or videos during trips for promotional purposes. We will ask for the consent of recognisable persons before publishing; you may decline by telling the skipper, or withdraw consent at any time by writing to our email.

12. Pets

Please contact us before booking if you wish to bring a pet; requests are assessed case by case depending on the type of trip.

13. Complaints and dispute resolution

You may address any complaint to info@sunnysailingbcn.com; we will reply within 10 working days. Official complaint forms of the Government of Catalonia are available. You may also turn to the Consumer Arbitration Boards or the European Commission's Online Dispute Resolution (ODR) platform.

14. Governing law and jurisdiction

These terms are governed by Spanish law, in particular Royal Legislative Decree 1/2007 (General Law for the Defence of Consumers and Users) and Law 34/2002 (LSSI-CE). Any dispute shall be submitted to the courts having jurisdiction under consumer law.
